    Of Counsel Richard M. Goldberg Of Counsel < Back Attorney Richard M. Goldberg is of counsel at Hourigan, Kluger & Quinn. He consults with the legal team on a variety of issues. Attorney Goldberg was formerly part of the firm’s Business Team. He started with HKQ in 1964. He was widely regarded as the dean of labor law in Northeastern Pennsylvania. A graduate of Dickinson College and Dickinson School of Law, Attorney Goldberg holds a Master of Laws degree in Labor Law from Temple University Law School. In 2006, he was given the President’s Award by the Luzerne County Bar Association for his service to the legal community. He is also the recipient of a special President’s Award from the Pennsylvania Bar Association for outstan ding leadership. He has been designated a Pennsylvania Super Lawyer in the areas of employment and labor law every year since 2005 and was ranked a Top-Rated Lawyer for 2013 in the same areas of practice by American Lawyer Media and Martindale-Hubbell, a national lawyer-rating firm. Corporate Transpar ency Act What Your Business Needs to Know New Law Affecting Businesses in 2024 A new law affecting business entities becomes effective January 1, 2024, and the lawyers at Hourigan, Kluger and Quinn, P.C., want to give you an insight into the law’s requirements. Please note that this information is based on current guidance and may evolve. The Corporate Transparency Act (“CTA”) requires a range of organizations to electronically file a report with the U.S. Department of Treasury’s Financial Crimes Enforcement Network (“FinCEN”) containing information on the business’s Beneficial Owners and Company Applicants. This message provides a summary of the key requirements of the Act and what you need to know to comply with the law. Hourigan, Kluger & Quinn can assist your business in navigating the filing requirements to properly comply with the law. A company's beneficial owners are those individuals who, directly or indirectly, exercise substantial control over a company or own or control at least 25% of the ownership interests of the organization. Substantial control is broadly defined and can apply to anyone who can make important decisions on behalf of a business. Ownership interest is also broadly defined and can apply to rights that are not characterized as debt or equity. Who May Be Company Applicants... Company applicants are individuals who directly file and are primarily responsible for filing, directing, or controlling the filing of the organization’s formation documents. The CTA goes into effect on January 1, 2024. Reports cannot be filed earlier. Companies created before January 1, 2024, do not have to report Company Applicant information, and will have until January 1, 2025 to report all other information, including Beneficial Owner information. New companies registered on or after January 1, 2024, must report all information listed below, including Company Applicant information within 30 days of receiving notice of an effective formation or registration. Covered Entities: The reporting rule applies to corporations, LLCs, and any other entity created by a filing with a Secretar y of State or Indian tribe equivalent. The reporting rule also applies to foreign entities that are registered to do business in any state or tribal jurisdiction. Information Required to be Reported: Business name and any d/b/a name Business street address Jurisdiction of formation (the state where the business was formed, which may be different than where it is currently located) Identification number (TIN, EIN, etc.) Full legal name, date of birth, current residential or business addresses. In addition, ID number from driver’s license or passport with picture of ID of a company’s Beneficial Owners and Company Applicants. Upon change of any reported information, an updated report must be filed within 30 days. There is a 90-day grace period to correct a mistake or omission in a report. Willful failures to report can result in civil or criminal penalties. Your Business May Not Be Required to File. The following entities are presently exempt from the CTA. Companies with 20 or more full-time U.S. employees and more than five million in U.S. sourced revenue and a physical operating presence in the U.S. Issuers registered with the SEC Banks and other money services business registered with the U.S. Department of Treasury’s Financial Crimes Enforcement Network Registered Commodity Exchange Act entities, registered investment companies or investment advisers, broker-dealers and registered venture capital fund advisers Insurance companies or state-licensed insurance producers Accounting firms Public Utilities Tax exempt entities Inactive companies Companies that were in existence before January 1, 2020 and No longer engaged in active business and Not owned by a foreign person, whether directly or indirectly or wholly or partially and No change in ownership in preceding 12 month period and Has not sent or received any funds over $1,000 directly or indirectly in the preceding 12 month period and Holds no assets and has no ownership interest in any other entity.     Tax Assessment You Are Here: Practice Areas > Real Estate > Tax Assessment Let Us Appeal Your Real Estate Taxes A Pennsylvania real estate tax assessment appeal can be a complicated process, best handled with the assistance of an experienced attorney. Hourigan, Kluger & Quinn’s real estate tax assessment attorneys are very familiar with the nuances of property tax rules. Hourigan, Kluger & Quinn represents landowners, Fortune 500 companies, commercial, industrial, and residential property owners throughout the entire assessment process – from the initial challenge, to any necessary trial and appellate court proceeding. Are You Overtaxed? Typically, commercial or industrial property values are substantially higher than their residential counterparts. When a Pennsylvania taxing district decides to appeal the assessments of some properties within its boundaries, concentrating solely on commercial or industrial properties may seem like a sound strategy. After all, raising the assessments on non-residential properties would usually result in a greater tax-revenue increase. When properties are not assessed separately, it can cost a commercial or residential property owner hundreds or thousands of dollars in unnecessary tax. Using State Law To Help Your Case The Pennsylvania Supreme Court unanimously ruled that it violates the Uniformity Clause of the Pennsylvania Constitution. The Uniformity Clause requires that “All taxes shall be uniform, upon the same class of subjects, within the territorial limits of the authority levying the tax.” (Article VIII, Taxation and Finance, § 1.) This means that a taxing authority is not permitted to implement a program targeting only the assessments of one sub-classification of properties, where that sub-classification is drawn according to property type (e.g., commerci al, apartment complex, single family residential, or industrial.) The person (or entity) appealing the assessment bears the burden of proof. At Least One of the Following Facts Must Be Established: The tax assessment relies on information that is incorrect or incomplete. The tax assessment sets the taxable value of your property higher than the taxable values of similar properties in your area. The tax assessment assumes that the current market value of your property is higher than it actually is.

Understanding medical treatment options after a workplace injury is crucial to make sure you receive proper care and compensation under Pennsylvania's Workers' Compensation Act. It’s important for you to explore the requirements, exceptions, and considerations regarding medical treatment panels and options for injured workers. Panel of Providers Requirement One key part of Pennsylvania's Workers' Compensation system is what’s called “the panel of providers requirement.” This requirement impacts where injured workers can seek medical treatment within the first 90 days after suffering an injury: Employer's Panel of Providers : Some employers maintain a designated panel of healthcare providers that injured employees must choose from for initial treatment. These panels typically consist of pre-approved medical professionals who are authorized to provide treatment to the employees under the Workers' Compensation Act. Treatment Within the Panel : If your employer has a panel of providers, you are required to seek treatment from one of these authorized providers for the first 90 days following your injury. If you fail to do so, it may result in your medical bills not being covered by workers' compensation. Exceptions and Legal Counsel : There are exceptions to this rule, and it is essential to consult with an experienced workers' compensation attorney to understand your rights and options.
